C9VoIP provides its services to you ("Customer", "you", “Client”, or "end user") subject to the following conditions. If you use our website or our Services or Applications, you affirmatively accept the following conditions. Continued use of the site, its Services or Applications constitutes the affirmative agreement to these terms and conditions. If you do not accept these terms do NOT use C9VoIP Services, Applications, or website. C9VoIP reserves the right to change these terms, conditions and notices under which the C9VoIP services, applications, and websiter are offered, including but not limited to the charges associated with the use of the C9VoIP sites and services.
When you visit C9VoIP’s websites or send Email to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by Email or by posting notices on this site including notifications posted to your user panel account page. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
All content on this site, such as text, graphics, logos, button icons, images, data compilations and software, is the property of C9 and is protected by international copyright laws. The compilation of all content on this site is the exclusive property of C9 and is protected by international copyright laws. All software used on this site is the property of C9 and is protected by international copyright laws.
You agree to provide C9VoIP with Your complete, and accurate personal name and/or business name, email address, billing address, shipping address, the addresses where the Services will primarily be used, email address, contact phone number, credit card information, and other data which may be necessary to administer Your C9VoIP account (“Account”) when You sign up for the Service and at other times as requested by C9VoIP. You present and validate that the information You provide is accurate, current, and complete, and agree to promptly update C9VoIP if any of the information changes. If You provide Registration Data that is, or that C9VoIP suspects to be false or inaccurate in any way, or otherwise unlawful, C9VoIP has the right to suspend or terminate the Service and refuse any and all current or future use of all Services by You, Your business(es), affiliates and all users of Your Account. You must maintain and promptly update your Account data at all times.
You, the Client, are responsible for managing the security of all passwords, PINs, and security questions and answers associated with Your Account. You will also be fully responsible for all actions and activities that occur as a result of disclosing, authorized or unauthorized, any passwords, PINs, and security questions and answers associated with the Account, even if You did not authorize said actions and/or activities. You are fully responsible for all actions that occur on Your Account. You shall immediately notify C9VoIP of any unauthorized use of Your Account or if any other security compromise has occurred. In no event shall C9VoIP be in any way responsible for any unauthorized use of Your Account.
C9VoIP may also share Customer Data to facilitate the delivery of the Service. However, C9VoIP will not share or sell your data to third parties outside of limitations to provide the Service only.
You accept and acknowledge that the Services may not be operable 100% of the time. Credit allowances for Interruption of the Services may be given on a case-by-case basis at C9VoIP’s discretion. Credit refunds are Your full and only remedy for any Service interruption or other issue with the Services.
We offer full refunds on remaining pre-paid balance upon request for all payments made within 60 days. We do not offer refunds for monthly subscriptions such as monthly plans such as SOHO, VirtualOffice, Residential plans, Local DID number’s, Fax numbers, or Toll Free numbers. There will be no refunds for one-time/setup fees. (custom toll free numbers).
5.1. C9VoIP shall not be held liable for any delay or failure to provide service(s) at any time. In no event shall C9VoIP, its officers, Directors, Employees, Shareholders, Affiliates, Agents or Providers who furnishes services to customer in connection with this agreement or the service be liable for any direct, incident, indirect, special, punitive, exemplary or consequential damages, including but not limited to loss of data, lost of revenue, profits or anticipated profits, or damages arising out of or in connection to the use or inability to use the service. The limitations set forth herein apply to the claimed founded in Breach of Contract, Breach of Warranty, Product Liability, Tort and any and all other liability and apply whether or not C9VoIP was informed of the likelihood of any particular type of damage.
5.2. C9VoIP makes no warranties of any kind, express, implied, or limited, to the service in which it provides.
5.3. C9VoIP provides prepaid services only. You must keep a positive balance to retain services with C9VoIP. You must pay all negative balances immediately. Customer agrees to keep a positive balance in customer’s account at all times and agrees to pay the rate in which the customer signed up for to all destinations. Customer agrees to pay any and all charges that customer incurs while using C9VoIP’s service.
5.4 You agree to be financially responsible for Your use of C9VoIP Services, whether it is authorized or unauthorized use of Your Account. In order to use C9VoIP Services, You must have properly configured and working Internet service and agree, at Your expense be responsible for all equipment necessary to establish a connection to Your Internet service, as required to use the Service.
5.5. C9VoIP Residential packages are intended for residential use only. C9VoIP unlimited local DID packages include a maximum of 4000 inbound minutes per month. If, for any reason, C9VoIP believes that You are abusing the unlimited plan or using for any unlawful reason, then C9VoIP may, in its discretion with or without notice, either terminate Your unlimited plan or immediately convert Your unlimited plan to a metered rate plan.
5.6. C9VoIP does not allow calls originating from Payphones to toll free numbers on its network.
5.7. Any call placed to Directory Assistance (411, or other) including Toll Free numbers (1-800-555-1212) will incur a $0.99 per call charge to be routed to the national Directory Assistance call center. 3.9. All calls placed through C9VoIP’s network to United States lower 48 and Canada destinations are billed at 6 second increments unless otherwise stated. All calls placed through C9VoIP’s network to international destinations are billed at 6 second increments with a 30 second minimum unless otherwise stated.
5.8. Use of C9VoIP’s services for telemarketing, broadcast faxing, delivery of unauthorized or unsolicited advertising, promotional materials or solicitations is strictly prohibited. Failure to abide by these terms will result in immediate account termination.
5.9. C9VoIP reserves the right to terminate service at any time with or without notice; especially if Customer is found to be in violation of C9VoIP’s Terms & Conditions. You agree that C9VoIP shall not be liable to you or to any third party for any modification, suspension or discontinuance of service. C9VoIP shall not be liable to You or any third party for any reason for terminating or suspending Your use or access C9VoIP Services. If C9VoIP terminates or suspends Your Services Account, You shall not be entitled to any refund or pro-rated amounts, or other amounts paid to C9VoIP before Your termination or suspension date.
5.10.Due to the nature of this industry and high credit card fraud rate, C9VoIP reserves the right to request the following documentation for verification purposes; A copy of the credit card used to establish the account along with valid photo identification such as a Passport, Drivers License or other Government issued identification. You authorize us to collect from Your payment method. If you have any unpaid balance amount, You agree to pay us interest at the lesser rate of (a) 18% per year or (b) the highest rate allowed by law for any amounts unpaid as of the due date. Acceptance of late or partial payments does not waive any of C9VoIP’s rights to collect the full amount due. C9VoIP may assess an additional fee of the lesser of (a) fifty dollars ($50) or (b) the highest amount allowed by law for any credit card chargeback or check returned for nonpayment. Written statements disputing charges must be sent to [email protected]
5.11 Taxes, Charges, and Fees. All fees for Services advertised or otherwise listed on the C9VoIP’s website are exclusive of any local, state, federal, sales, international, value-added, any other regulated tax or fees. You agree to pay all Taxes and Fees and/or similar charges that may be debited against the Services which are regulated by any federal, state, local, or international law or regulation, as well as any administrative and recovery fees and charges debited against Your Services Account. If your Services Account is required to pay any tax or fee, You agree that C9VoIP may charge Your credit card on file for such payments.
Monthly Plan Customers. For monthly plan customers, You may cancel or terminate Your Services Account at any time by calling customer service at 855-929-8647. Outstanding of any remaining fees on Your Service Account, C9VoIP charges no termination fee.
Annual Plan Customers. For annual plan customers, You are purchasing the Service for the full length of the applicable annual Service term. You have thirty (30) days from the original date of Service purchase for a pro-rated refund. After thirty (30) days, if You terminate the Services before the end of Your annual Service term, You are responsible for all charges remaining on your Service term including taxes, and fees.
C9 VoIP service does not include technical assistance for third party devices. This includes PC’s, Mobile Smartphones, IP Phones and ATA Adapters. Support services can be engaged for contract or hourly rates.
We do provide sample configuration for Desktop, Mobile, ATA, and Digital IP Phone Devices which are easily accessible from our website.
We reserve the right to make changes to our site, policies, and these Terms & Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
Due to recent pursuant FCC rulings and regulations, All customers who are using C9VoIP services as their primary residential or business telephone carrier must activate 911 Emergency Services on at least one of their DIDs. Enhanced 911, the portion of our 911 service which delivers physical address information to your local PSAP (Public Safety Answering Point) is not guaranteed. It is possible that your physical address information may not be passed to the PSAP dispatcher. On occasions such as this you will be required to give the dispatcher the location of your emergency in order to receive emergency service assistance.
Enhanced 911 service is not available to every location within the United States at this time. For locations where e911 is not currently available, You will be required to announce the location of your emergency to the PSAP dispatcher. Due to the nature and instability of VoIP networks, we cannot and do not guarantee your emergency call will complete. Loss of power, Internet access and or several other conditions may cause 911 to be inoperable. C9VoIP has no control over those types of situations and are not held liable. C9VoIP will do everything within their power to prevent service outages within it’s network.
C9VoIP requires you set the accurate Caller ID in order for e911 address information to be passed to your local PSAP dispatcher. By agreeing to these Terms & Conditions, You agree to set the outbound Caller ID number to the DID you have enabled e911 services for when making an outbound 911 emergency call. Failure to set the correct caller ID value will result in a non-refundable $85 surcharge per 911 call.
By using C9VoIP’s Enhanced 911 service, Customer agrees that C9VoIP, it’s contractors, executives, members, customers, agents, employees, carriers, 911 providers, and any anyone else associated with C9VoIP is not held liable for emergency calls failing, even if it is determined that it is the fault of C9VoIP or it’s associates. Customer further agrees that they will notify their Customers, contractors, agents, employees, associates, shareholders, partners, and anyone who may use the C9VoIP 911 service of our limitations and make Customers agree to not hold C9VoIP or Customer liable. Failure to enable e911 service will result in a non-refundable $85 surcharge per 911 call.
C9VoIP shall not be held liable for any delay or failure in Services caused by reasons beyond its control, including without limitation to, acts of God, earthquake, fire, flooding, fiber cuts, actions or inactions of third party providers or suppliers, government requirements, or any other event that is beyond the reasonable control of C9VoIP.
In the event of any dispute, claim, question, or disagreement between You and C9VoIP (“Dispute”), You and C9VoIP shall first use reasonable best efforts to settle the dispute, claim, question, or disagreement. To this end, You and an authorized member of C9VoIP’s legal department (or other representative of C9VoIP designated by the legal department) shall consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. Neither You nor C9VoIP shall file or pursue any Disputes in any court, administrative, arbitral, or other adjudicative body prior to engaging in such consultations and negotiations. You agree that any Disputes shall be adjudicated in the state and federal courts of the State of Florida, U.S.A. Venue for any Disputes shall be the Superior Court of Florida, County of Broward for state court cases, and the United States District Court of the Southern District of Florida for federal court cases. You agree to submit to the exclusive jurisdiction of such courts with respect to any Disputes and agree not to bring any Disputes in any other court or adjudicative body. You hereby consent to venue and personal jurisdiction in such courts with respect to such Disputes and irrevocably waive any right that You may have to assert that such forum is not convenient or that any such court lacks jurisdiction. Notwithstanding the adjudication requirement above, for any Disputes involving ten thousand dollars ($10,000) or less, either party may choose to resolve such Dispute through binding, non-appearance-based arbitration (i.e., arbitration conducted online, through written filings, and/or via teleconference). Such arbitration shall be conducted through an established alternative dispute resolution provider mutually agreed upon by the parties, and any judgment rendered by the arbitrator may be entered in any court having jurisdiction. The arbitrator’s decision shall be final and legally binding. In the event of any litigation (including arbitration) between You and C9VoIP, the non-prevailing party shall reimburse the prevailing party for all reasonable and documented attorneys’ fees, costs, and expenses relating to the Dispute.
This Agreement and Your use of the Applications and Services shall be governed by and construed under the laws of the State of Florida and the United States without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement or Your sign up or use of the Applications or Services.
